General Terms and Conditions
DAY ONE Recruitment AG
 

The following General Terms and Conditions of DAY ONE Recruitment AG (hereinafter referred to as "Day One") apply when Day One provides recruitment services to a client on a case-by-case basis without creating any additional obligations. This document does not obligate the client (hereinafter referred to as "Client") to use Day One's recruitment services.

Subject Matter of the Contract

Day One is a specialized recruitment consultancy that places specialists and executives for its clients. Day One matches its entire candidate database with company profiles, job vacancies, and requirements and leverages a personal network to identify the right candidates. Costs are only incurred after a successful placement.

The following terms also apply to recruitment services where Day One proactively introduces a candidate to a client and offers them a position without a prior recruitment mandate.

These terms apply to the following services provided by Day One:

  • Consultation regarding suitable sourcing strategies for profiles

  • Market analysis concerning the target profile

  • Assessment of the market-standard salary level for a given profile

  • Research and identification of suitable candidates

  • Initial contact and competency interviews with target candidates

  • Selection and submission of suitable application documents

  • Ongoing support throughout the selection process until contract signature

 

Candidate profiles are compared by Day One with the Client’s requirements. It remains the Client's sole responsibility to assess whether a candidate introduced by Day One meets the required qualifications and all other criteria.

Client's Obligations

The Client shall provide Day One with all necessary information required for the analysis, research, and selection of suitable candidates, in particular a detailed job description. Day One may also conduct a verbal needs analysis with the hiring manager if it considers this likely to enhance the recruitment success.

Fee

If the Client hires a candidate introduced by Day One, the placement fee becomes due. The fee is calculated based on the "total compensation" (= gross annual salary plus bonus). Day One charges a one-time, success-based fee for a successful placement. In the case of a part-time position, the fee is calculated based on a full-time equivalent and adjusted accordingly.

Additional costs related to the job advertisement or candidate presentations (e.g., travel expenses) and any other expenses arising under these conditions are only charged if previously agreed with the Client. Publication of job advertisements on the Day One website is free of charge but may be declined by Day One.

All fees are exclusive of VAT at the applicable statutory rate. Day One will issue an invoice upon signing of the relevant employment, service, or consulting agreement. The invoice is payable within 30 days of receipt without deduction.

If the Client hires a candidate proposed by Day One within 12 months of introduction, Day One is entitled to claim the placement fee. This also applies if the Client contacts the candidate during the 12-month period but hires them afterward, even for a different position than originally intended. The relevant date is the rejection notification from the Client or the candidate to Day One. The Client commits to informing Day One immediately when contacting the candidate or if an employment contract is concluded.

If a candidate placed by Day One leaves the Client's company during the contractual probation period, Day One will credit 50% of the placement fee toward future services.

Confidentiality and Data Protection

Both the Client and Day One agree to maintain strict confidentiality regarding all transmitted information and the contents of these terms. Reference checks by the Client are only permitted after prior consultation with Day One.

All documents provided by Day One about a candidate remain the property of Day One and the candidate. These documents, along with any data and information contained therein, must be treated as strictly confidential and may not be shared with third parties. Submitted application documents are subject to data protection laws, except for materials relating to candidates who are hired by the Client.

If any of the information transmitted by Day One includes personal data of a candidate, Day One remains responsible for the processing of such personal data.

Final Provisions

Any amendments or additions to these terms must be mutually agreed upon.

For any disputes arising out of the relationship of trust between Day One and the Client, the place of jurisdiction is Zurich, the registered office of Day One. These General Terms and Conditions are subject to Swiss law.

These General Terms and Conditions are effective as of April 1, 2022, and replace all previous agreements.
